Six months ago today obama had his first full day in office as president. Reports from all over make it clear he’s lost his famous mojo.

Health Care Reform? Likely off the table until after the August recess of Congress. Flanks from all sides have turned in on obama in the middle, who is trying so hard to please everyone with his wishy-washy nothing-burgers, and being EATEN ALIVE by the corporate interests we always KNEW ruled his world.

While the Right Flank screams, “Bolshevism!” the Left Flank screams, “Oligarchy.” Both are right. Obama-Care WOULD be Bolshevistic in outcome, if not in intent. Taxing the hell out of the rich with surtaxes and the middle class with taxes on benefits at the same time that there are ZERO cost-control measures in place is a SURE fire way to break the system in the Old School Soviet Style. Small businesses owners will be out for BLOOD if they are forced to pay an 8% payroll penalty. Middle class families who now struggle with inadequate, confusing, frustrating, and EXPENSIVE employer-subsidized insurance will be justifiably FURIOUS if they are forced to

  1. Pay taxes on the (mostly lousy) health insurance they have because they’re lucky enough to have a freaking job.
  2. Be shut out of cheaper, more comprehensive government-sponsored insurance plans.
  3. Subsidize the government plan they’re not allowed to join.

Holy Smokes. What a stupid, stupid idea it would be to add another component to the Middle Class Misery Index right about now.

And, though the moron David Brooks pretends not to know it, REAL liberals have been SHUT OUT of the Health Care reform debate altogether. As anyone in Massachusetts knows, covering the uninsured is not all that difficult. The REAL problem is how to pay for it all. And the ONLY way to pay for Universal Health Insurance is a strong, government option open to EVERYONE. By conceding the opportunity to allow a public plan to actually COMPETE with private, for-profit insurance comapnies, Obama Care is guaranteed to not only FAIL, but to bring the whole system down when it goes. (is obama secretly working for Grover, “Drown-the-Government-in-the-Bathtub,” Norquist?). But obama won’t take on the Corporate Big Whigs who put him in office. That’s Oligarchy.

And the Right has every right to jump on the CBO estimates that Obama Care will break the bank. Reports that bank and financial sector bailouts could cost the U.S. Taxpayer $24 TRILLION dollars (yes, you read that number correctly) merely add fuel to an already raging fire of righteous cries of “Tax and Spend (On Your Billionaire Buddies).” Just because the Republicans don’t have any meaningful or practical solutions doesn’t mean they’re wrong that Obama Care is a very, very bad plan.

What a wonderful brew: Bolshevik Oligarchy.  Sound familiar?

So. Health Care Reform six months in to the Age of Obama? Grade: FAIL.

The Stimulus Plan? BWAHAHAHAHAHA! Don’t even get me started. Unemployment estimates from economists of every stripe range from Holy Smokes to Holy Shit!  Barely any of the money has been spent on saving or creating jobs, and the situations in the states is getting WORSE and WORSE.

So. Improving the Economy (even just a leetle bit) six months in to the Age of Obama? Grade: FAIL.

Closing Guantanamo? Oops! Put off again for AT LEAST another six months. Glenn Greenwald better take a few days off or he’s going to blow a gasket.

So. Reversing the Bush Slide Into Executive Authoritarianism and Ending the Wars in Iraq and Afghanistan? Grade: FAIL.

Greater Transparency? Forget about it. Grade: FAIL.

Reverse DOMA? Oh, please. End DADT? Don’t hold your breath. President Homofauxbama will NEVER reverse DOMA or DADT. Grade: FAIL.

Reverse the Conscience Clause? Yeah, right. The president’s top budget man, in charge of Obama-Fail-Care, has already made it clear the White House won’t fight to include women’s health coverage in the overhaul (click on this link, it’s got a KILLER closing paragraph.) And Democrats in Congress who oppose reproductive freedom have blankly stated they won’t vote to include “women” in health care reform. When the president of the United States of America says to the world that he will fight for the right of Muslim men to FORCE women into submission there is something SICKENINGLY WRONG with our government.

Think about the previous paragraph (and I do urge you to click on the links) for a moment. We’re more than half the population. We’re more than half the voters. By every measure of social health, women’s reproductive freedom and health are ESSENTIAL to the effort to increase quality of life and prosperity in every nation on Earth, including ours. Yet our elected representatives DO NOT CARE. They have explicitly rejected our most basic needs as “special interest” and “divisive.”

But we still hear, daily, from those who would discourage us from voting for women. Who would discourage us from considering the gender of a candidate as an essential reason to support her. Even though NOT ONE improvement in the rights, freedoms, and quality of life of American women was EVER championed by a man. YES, all-male legislators enacted the 19th Amendment and an all-male Supreme Court decided Roe, but that was only well after thousands and thousands of women rallied and worked (together, god damn it) FOR HUNDREDS OF YEARS to FORCE them to do it for us.

And it’s been downhill ever since. How can it be difficult, after considering the historical record of women’s oppression in this country to NOT conclude that the ONLY way to keep our rights as fully-fledged citizens secure is to make damn sure at least SOME women are holding the reins?

I agree there are people out there who *need* insurance, but health insurance is not “one size fits all”. If the current legislation / govt. plan allowed me to:

1. Keep my own insurance and change it within the rules I currently have (annual enrollment);
2. Force my insurance carrier to have more “preferred providers”…or better yet, to force all physicians to sign up as preferred providers for all insurances (I live in a remote area, and it’s tough to find a “preferred provider” in my plan);
3.. If I change insurance carriers, they should cover pre-existing conditions;
4. Catastrophic illness should be better covered so that such an illness will bankrupt me or my family.

5. And it should pass the *smell* test of whether or not Congress will sign up for it. If they decline, then I’ll be against it everytime. That is the one key warning flag for me on anything Congress passes.

The way I read it – it is totally deceptive to suggest that people (70 percent Americans rated their coverage as good or excellent liked) can keep their insurance – few people are questioning because they have bought into BO’s oft repeated ‘you like it, you keep it’ ‘you like it, you keep it’

Because I promised, and in case any PUMAs are interested, below is a draft of a possible letter to send to Reps/Senators calling for a full Congressional hearing/investigation into the Walpin firing. Many thanks to RememberNovember for suggesting some excellent edits. Also, many thanks to all PUMAs who participated in the previous ageism protest, and thanks to webfoot for her outstanding help. I’ve previously posted the response letter I received from the EEOC.

Because the ageism protest letters may have gone to a somewhat limited number of Congressional members, I drafted the letter below in the belief that a more general approach might be in order. I’ll leave it to Murphy and PUMA legal brains to assess/determine.

Dear Member of Congress:

I am writing as an American citizen and taxpayer to urge you to demand a full Congressional hearing and investigation into President Obama’s firing of Gerald Walpin, Inspector General of the Corporation for National and Community Service (CNCS/Americorps).

Available facts indicate that Mr. Walpin’s firing was patently unwarranted, illegal and unconstitutional. Mr. Obama and his administration appear to have violated federal laws, regulations and statutes, as well as the U.S. Constitution from which such rules emanate including, but not limited to, some or all of those listed below.*

The American Recovery and Reinvestment Act, which Mr. Obama signed into law in February, includes $201 million for CNCS to expand AmeriCorps. In diligently striving to ensure accountability and transparency to the American people, prior to his firing, Mr. Walpin had uncovered and documented funds misuse by at least two organizations receiving Amercorps funds, including one founded by a political supporter of Mr. Obama.

Mr. Walpin is rightly fighting back and has been calling for a full Congressional hearing and investigation. Our nation has made great strides in combating various forms of discrimination. We must not allow age-based discrimination and politically motivated reprisal to stand unchallenged, particularly when perpetrated by individuals at the highest levels of government.

If allowed to stand unchallenged, Mr. Walpin’s firing would send a chilling message to some 69 other U.S. Inspectors General whose watchdog activities must remain unfettered, particularly when their work is so vital during these disastrous economic times, when millions of Americans are stretching ever-shrinking paychecks and millions more are without employment. Allowing this despicable act to stand unchallenged would also send a dreadful message to all Americans that their rights are expendable in the face of political corruption and cronyism.

It is your job to serve the best interests of all American citizens whose hard-earned tax dollars fund your salary and benefits. I urge you to honor the trust that American citizens and taxpayers have placed in you as their public servant and immediately demand, and participate in, a full Congressional hearing into the firing of Inspector General Gerald Walpin.

Draft of possible letter

Dear Member of Congress:

I am writing as an American citizen and taxpayer to urge you to demand a full Congressional hearing and investigation into President Obama’s firing of Gerald Walpin, Inspector General of the Corporation for National and Community Service (CNCS/Americorps).

Available facts indicate that Mr. Walpin’s firing was patently unwarranted, illegal and unconstitutional. Mr. Obama and his administration appear to have violated federal laws, regulations and statutes, as well as the U.S. Constitution from which such rules emanate including, but not limited to, some or all of those listed below.*

The American Recovery and Reinvestment Act, which Mr. Obama signed into law in February, includes $201 million for CNCS to expand AmeriCorps. In diligently striving to ensure accountability and transparency to the American people, prior to his firing, Mr. Walpin had uncovered and documented funds misuse by at least two organizations receiving Amercorps funds, including one founded by a political supporter of Mr. Obama.

Mr. Walpin is rightly fighting back and has been calling for a full Congressional hearing and investigation. Our nation has made great strides in combating various forms of discrimination. We must not allow age-based discrimination and politically motivated reprisal to stand unchallenged, particularly when perpetrated by individuals at the highest levels of government.

If allowed to stand unchallenged, Mr. Walpin’s firing would send a chilling message to some 69 other U.S. Inspectors General whose watchdog activities must remain unfettered, particularly when their work is so vital during these disastrous economic times, when millions of Americans are stretching ever-shrinking paychecks and millions more are without employment. Allowing this despicable act to stand unchallenged would also send a dreadful message to all Americans that their rights are expendable in the face of political corruption and cronyism.

It is your job to serve the best interests of all American citizens whose hard-earned tax dollars fund your salary and benefits. I urge you to honor the trust that American citizens and taxpayers have placed in you as their public servant and immediately demand, and participate in, a full Congressional hearing into the firing of Inspector General Gerald Walpin.

Hizb Ut-Tahrir held its “The Fall of Capitalism and the Rise of Islam” conference at a Hilton Hotel in the suburbs of Chicago

Security at the conference was very tight. Oak Lawn police maintained a checkpoint outside the Hilton, and local police and HT’s own security people had a substantial presence inside the hotel. In the ballroom where the conference took place, men and women were largely segregated, with men in the front and women in the back. This became a significant point of contention between HT supporters and several members of the audience who objected to this arrangement. At one point, an unidentified Hizb ut-Tahrir speaker became flustered over this line of questioning.

“Men and women,” he blurted out, must be kept separate “to prevent people from behaving like animals.”

A woman in the audience responded: “How does intermingling between men and women make you animals?” HT panelists didn’t have a persuasive answer, and soon adjourned that session.

The conference was sometimes poorly organized. There was no list of speakers, forcing reporters to sometimes guess at the spelling of speakers’ names. But HT certainly appeared to be serious about working for the larger goals of the conference: abolishing capitalism and imposing Caliphate rule over the world.

My niece who works for a Major Health Insurance Company mentioned that her company was positioning itself to run the government plan – so why would they object to a Bill that would likely put their private coverage out of business? They have another in the wings? But they cannot all run the government plan

Can you keep your current plan? A new study out by the “Lewin Group”:

This weekend President Obama dedicated his weekly address to defending Congress’s plans for an overhaul of the nation’s health-care system.

He argued, “Once you’ve seen enough ads and heard enough people yelling on TV you might begin to wonder whether there’s a grain of truth to what they are saying.”

Here’s the truth, brand-new analysis (pdf) from The Heritage Foundation — conducted by The Lewin Group — shows that the public-plan component within the House Democrats’ health reform bill is in conflict with how the Congress and the President are selling their reform plan.

“If you like your health plan, you can keep it, the only thing that will change is that you’ll pay less.” Remember that? Well, according to the new Lewin study:

* Approximately 103 million people would be covered under the new public plan and as a consequence about 83.4 million people would lose their private insurance. This would represent a 48.4 percent reduction in the number of people with private coverage. (see page 5 of the study)

* About 88.1 million workers would see their current private, employer-sponsored health plan go away and would be shifted to the public plan. (see page 5 of the study)

* Yearly premiums for the typical American with private coverage could go up by as much as $460 per privately insured person, as a result of increased cost-shifting stemming from a public plan modeled on Medicare. (see page 18 of the study)

So, is there truth in the way the President and Congress are advertising their plans?

In his address President Obama asserted that, “If you like your current insurance, you keep that insurance. Period. End of Story.” But what the president forgot to tell you is that his assertion is only true if the story were fiction.

President Obama has stated that any plan he’d sign must include a health insurance exchange with a public “option.” So, if you like your current insurance you may, in fact, lose it. Period. End of story.

I have health insurance from my husbands Veterans disability, its called ChampVA. And I have absolutely no complaints. Its simple, straightforward, I choose my own doctors, there is no approved list or preferred providers, there is no referral for a specialist, it pays 75% up to an out of pocket yearly deductible of $3000 for the whole family, and then everything else is for the remainder of the year after that is covered at 100%. There is no lifetime limit, and it includes prescription benefits. Most times I pay only a buck for my prescriptions and if I use the meds by mail program it costs me nothing. If the healthcare reforms were modeled after ChampVA, we’d be pretty blessed, although I am sure someone somewhere would think the out of pocket per year was too high. You’re never going to please everyone I don’t care what they pass. What I do know, is my son who is a cancer survivor at 26 will never be able to get insurance coverage without a 2 year pre existing conditions clause, and what exactly is he supposed to do for those 2 years?

I have health insurance from my husbands Veterans disability, its called ChampVA. And I have absolutely no complaints.

That sounds darn good to me too jdona. I have Kaiser, from my job, in a nice area and I have never had a bad experience with the doctors. One young female doctor had a cold bedside manner and I swapped her out.
My son has a chronic illness with no insurance and he is in the same boat. Socialized medicine may not be perfect, there are ways to get around it, but NO INSURANCE for the sick is inhuman!

Good to see you blog and I hope your son remains healthy and has a happy and long life.

Although there are some positive provisions in the current House Tri-Committee bill – including insurance for all and payment reform demonstration projects – the proposed legislation misses the opportunity to help create higher-quality, more affordable health care for patients. In fact, it will do the opposite.

In general, the proposals under discussion are not patient focused or results oriented. Lawmakers have failed to use a fundamental lever – a change in Medicare payment policy – to help drive necessary improvements in American health care. Unless legislators create payment systems that pay for good patient results at reasonable costs, the promise of transformation in American health care will wither. The real losers will be the citizens of the United States.

After being in big fights on the not so friendly blogs, I have been more excited in the last few days, when I realized that the American people are finally WAKING UP to the truth about Obama. What we have know for well over a year is finally sinking in.

Looks like we will have many more fights as Obama has called out his dogs again. Now they are a lot easier to recognize than they were over a year ago, and we know how to deal with them better.

We cannot live through four years of this Presidency. It has to stop very soon. Hopefully, Obama’s lame duck status will officially begin right now.

Actually cap and trade is even worse than you have pointed out. But you did point out their selling points.

Cap and trade is the new “subprime loans” for the financial markets so that they can keep making money hand over fist by buying, selling, and running up the costs of those “energy trades”. Same dudes who ran up the cost of the internet stocks then burst them when they cashed in their chips. Cap and trade is their new money making scheme and Obama knows it. Which is why Obama is pushing it.

They gave him the money to become President, he hired all of the Goldman Sachs alumni for his administration and put others in power, now he is going to pay them back with Cap and Trade so they can keep this farce going for 8 years. We cannot Live through 8 years of Obama. Hell, we cannot even live through 4 years of him.

It’s all to help out the Goldman Sachs and George Soros’ of this world, on the back of the American taxpayer. We will pay for it coming and going, while they will make tons of money on it.

Wonder why Goldman Sachs has so many people in the WH, the NJ Gov was formerly the Chairman of GS, who Obama just came to NJ to stump for last week, and why GS just posted quarterly profits
that enable them to give every employee at least a $700,000 bonus for the second quarter alone?
Goldman Sachs bosses got much higher amounts in their bonus. George Soros admitted he made money on the crisis last year…the one that put Obama into the Oval office.

These guys will lie to your face, laugh behind your back, and take away your money, as long as they can make money. Obama has never cared about the poor. Look at his record in Chicago. He uses the poor, then turns his back on them.

Letter to my representatives in the Congress and Senate

I am not in favor of Obama’s health care plan or cap and trade.
Do not vote for either of these current proposals.

NJ will vote for our change when the next election occurs and Corzine’s position is very much on the line. Corzine is identical to Obama and NJ does not like the policies that have taken NJ down a very dangerous path. Obama is taking the nation down the same path.

This is not the change that we want. Obama is taking down this country as fast as he can and there will be a huge revolt if he is not stopped now. The 2009 governor elections are just the beginning of that revolt.

We also don’t want Obama changing the census to be under Rahm and run by ACORN.
Obama bringing Chicago tactics to the national level is a disgrace.

We may have to watch the Dems plans play out until everyone is wide awake to what Obama is up to here. Then he and everyone who votes for more outrageous programs, just because Obama chides them, will be replaced by people who do care about this Republic.

The Stimulus has not worked. We don’t need to throw away more money on iffy big changes that appear to have no benefits other than to increase the power of the President and Federal Government.

excellent post, Murphy. You know, and probably everyone who blogs here knows, that if abortion is not funded then there are women who do not have that as a choice. Ironically, conservatives complain about women on welfare having so many children. Hmmmmmmm, maybe that is because some of those women at least some of the time considered but were unable to abort or take the morning after pill?

Women were created with the power over life and death, and male leaders do everything they can to interfere with it because they are scared of us. And worse, they get into the death business because killing is something they can do. And they dare to moralize about a woman’s choices?

Surely now the progressive Democrats who voted for Obama are puking. I know I have had to turn off the tv because I can’t watch the fawning media without losing my appetite. In fact, I’ve lost twenty pounds since Obama was elected!

Here’s a novel idea: Why don’t the congressmen come up with a national lottery and pick – I dunno – maybe 10,000 to 20,000 names from that lottery to participate in a national healthcare plan they’ve designed, for the next year or two. The participants would have to meet a list of rigorous qualifications (ie, Am. citizen, unemployed or below a certain income level, with no other health insurance options). Pick a board of ‘overlords’ – with equal number of republicans & democrats that would be responsible for reporting the outcome at the end of the trial and closely integrated within the system….somehow.

Then at the end of the trial and publishing of the report, let the American people decide if they want to join the plan too.

You know, we’re always advised not to dive head first into waters where we don’t know the depth of the water. Why does Congress insist on diving head first into this unknown territory? What’s wrong with a cautious approach?

Let that sink in. A handful of people who probably never even ran a small business actually think they can reinvent the health care system.

Politicians and bureaucrats clearly have no idea how complicated markets are. Every day people make countless tradeoffs, in all areas of life, based on subjective value judgments and personal information as they delicately balance their interests, needs and wants. Who is in a better position than they to tailor those choices to best serve their purposes? Yet the politicians believe they can plan the medical market the way you plan a birthday party.

Leave aside how much power the state would have to exercise over us to run the medical system. Suffice it say that if government attempts to control our total medical spending, sooner or later, it will have to control us.

Also leave aside the inevitable huge cost of any such program. The administration estimates $1.5 trillion over 10 years with no increase in the deficit. But no one should take that seriously. When it comes to projecting future costs, these guys may as well be reading chicken entrails. In 1965, hospitalization coverage under Medicare was projected to cost $9 billion by 1990. The actual price tag was $66 billion.

The sober Congressional Budget Office debunked the reformers’ cost projections. Trust us, Obama says. “At the end of the day, we’ll have significant cost controls,” presidential adviser David Axelrod said. Give me a break.

The Air Force has just informed me that i was approved for early retirement. That means i only have 3 months left before i get to move to Alaska to met up with the family. I will officially remove my uniform for good on the 30 of November. A great Female Senator helped me in this matter when no one else would. I am thankful to the few people who did the right thing.

Nearly eight months later, the Minneapolis DFLer faces a House Ethics Committee review of his decision to keep the trip’s costs under wraps — even though it was paid for by a local Islamic nonprofit and typically would be reported as a gift to a public official.

Asked about the trip Tuesday, Ellison said that he is “not privy to the internal workings of the organization” that covered his costs, and that he complied with all House Ethics panel disclosure requirements. “Why should I waive a right that’s accorded me under the rules?” he said.

Tax records show the group that paid Ellison’s expenses, the Muslim American Society of Minnesota, received nearly $900,000 in taxpayer money in 2006 and 2007 from a rental arrangement for Tarek ibn Ziyad Academy (TiZA), an Inver Grove Heights charter school.

The man who accompanied Ellison to Mecca, Asad Zaman, is executive director of the TiZA school, a political contributor of Ellison’s and was president of the Muslim American Society until August, when the Mecca trip was planned.

TiZA has been sued by the American Civil Liberties Union and probed by state officials for allegedly promoting Islam, which would violate the church and state separation required of public schools — including charter schools.

Our President does not know what is in HR3200

Silence Dogwood – thanks for the list of problems with HR3200. Did you retype all those twitters? If so, thanks again.

The author did not include the one I was talking about yesterday on pages 16- 17 of HR3200. The grandfather clause that does NOT appear to protect those of us who are happy with our present insurance (70% of the population in May this year) and allow us to keep it.

This is what tripped up the President yesterday in a conference call to ‘liberal’ bloggers (see TT’s link #114)

One blogger asked “Will people be able to keep their insurance and will insurers be able to write new policies even though H.R. 3200 is passed?” President Obama replied: “You know, I have to say that I am not familiar with the provision you are talking about.” If you want to hear for yourself the audio is at (is it still there?):

Can you BELIEVE this? The president does not know what is in the Bill and none of his people seem to have told him. The poor blogger has not received kudos from his buddies (to put it mildly) at Daily Koz (only the second time I’ve been there) for exposing the President to potential ridicule. Actually I have respect for the blogger for trying to get an honest answer to an honest question.

At the end of the Conf Call BO reiterated:

“If you have health insurance, and you like it, and you have a doctor that you like, then you can keep it. Period.”

How can BO keep making this promise if he is not familiar with the health legislation that is being written in Congress? The devil is in the details.

Please ask your Senators, ask your Reps and ask them to READ the Bill and to SLOW down so that health care reform is done properly. For me it is all a matter of trust and I just don’t have it – scares me. Thanks

Although I appreciate links to other sites to gather information, I would like to remind PUMAs to read the original documents before trusting a breakdown of the Health Care bill from a blogger.

Don’t get me wrong, I don’t think the Baracko Health Care Bill is a prescription written off of Mayo Clinic’s scrip pad, but I also don’t like someone opposed to a bill to make a blank statement over and over about the same thing, (you have no choice, you get old and they will make Soylent Green out of you, or you will have your flesh and income exposed for the world to see.) This is politics, not research and disclosure.

I would rather see the PUMAs do their 10 page reading marathon and breakdown than some blogger I do not know.

PUMAs are more intelligent, fair and accurate.
I will not read the entire HC bill alone, but I will volunteer if enough others join me.

The female Senator is the Honorable Lisa Murkowski. She hasnt sent me my final response yet but i know she played a big part in helping out me and my family. Please hold off until i get my final letter from her and will let you all see what she rights.

The important thing in this matter was in this day and age when we want to do what is best for everyone involved, alot of times there are people in power who cause obstacles just because they can, well she made the difference for us and i truely believe i would be forced to stay in longer if it wasnt for her. Needless to say i feel thankful and she will always have my support and devotion as a voter in the state of Alaska.

Lexi, who is my granddaughter, has started dialysis and she is now on the National Registry for a kidney.

If you know of anyone who would be willing to give one of their kidneys to Lexi, who is 11 years old…was diagnosed with cancer (neuroblastoma) when she was 3 years old and because of where the cancer was, her kidneys are destroyed and she is desperate, then please let me know.

She is B positive so we need someone who is either B or O positive, and then there are tests they would need to take to make sure they are compatible with Lexi…which takes a month or two of testing. Lexi’s insurance will pay everything.

If you are interested or know someone who is interested, please let me know and pass this around to others, your other groups, etc.

Okay, I’m not even supposed to be here…shhhh…But there are several issues of immediate concern to me today, and so thought I’d share.

1) Re BO’s ‘healthcare reform’ and ‘crap n tax’ plans, has anyone noticed that the BIG CORPORATE interests are not visibly/vocally lobbying like the dickens against either of these??? So, IMO, it should be rather obvious that the major players in these two industries will be making megabucks at the expense of everyday Americans if these plans pass. Otherwise, BIGTIME lobbyists for both would have been wining and dining and paying off Congress to oppose them. That’s not happening. Add to that the fact that BO has had secret meetings with representatives from both industries, and refuses to divulge who attended or what was discussed. Thus, can either plan be any good for the everyday American??? I say e-mail and fax the heck out of your Congressional Reps and Sens against both plans, and do not wait!!!

2) I’m concerned about what will happen to any of various pending lawsuits involving BO and cronies in the event his pal Sotomayor is approved for SCOTUS. There are articles indicating that Sotomayor initially may have tried to ‘bury’ or ‘hide’ the Ricci case — perhaps the most significant race case in decades — from further judicial review; and indicating that some 1200 pages of Clinton-era White House communications re Sotomayor’s nomination to the circuit court of appeals were withheld from the public. Again, if you’re concerned, e-mail and fax your Reps/Sens.

Hello there. I should try to generate some ideas for Sarah as to your comment 3 – not sure when I will have time this week. I did want to share something about comment 2. I read the Ninth Justice article – thanks for the link. Several weeks ago I reviewed the Ricci case (both at the district court level and the appellate court proceedings). Honestly, Sotomayor is getting unfair criticism regarding Ricci. Several reasons – first, the lower court opinion is well reasoned. Ricci wanted to be promoted based on his scoring well on a test that was, beyond dispute, a test whose results could not be used for promotion without the certain result of a valid claim of discrimination. The test was a bad test – not Ricci’s fault, not Sotomayor’s fault. It is just a test that should not have been used. They should have promoted Ricci, perhaps, but why not use a valid promotional tool? Secondly, Sotomayor and the other two judges could not have hidden the case from anyone. What Ricci’s lawyer said SO MANY lawyers say because MANY case are affirmed without a reasoned analysis. In Florida, if your appeal is “affirmed per curiam” in the way the Ricci case was affirmed, no review would be possible. Sure, the lawyer griped that there was no opinion. That happens just about every day. Affirming without opinion happens so often that no one can conclude from that practice that a case could be hidden. Everyone is on notice of that frequently occurring. In any event, Ricci had two levels of review of the short affirming opinion, and he took advantage of both – he could apply for “en banc” review and he could apply for Supreme Court review. The court en bank voted to affirm – 8 to 7. So, 7 other judges agreed with Sotomayor. It is very hard to get Supreme Court review, but the manner in which the 2nd circuit opinion was written had nothing to do with whether the Court was going to grant review. The briefs submitted by Ricci’s lawyer and the other briefs in favor of review provided everything necessary for the Supreme Court to consider the issues.

Sotomayor’s participation in the reversed ruling is being made much of, but frankly she was just one of three judges affirming an opinion that had a basis in law and one of eight judges agreeing that the case should not be reviewed on rehearing. What Sotomayor is being criticized for is refraining from being activist – yet everyone thinks she is an activist and should be criticized for that too.

Once again, and I don’t direct this at you, CJK, but in terms of the Republicans and media who are out there criticizing Sotomayor, it is a double bind that only applies to women. Have we ever seen a male jurist up for confirmation being placed in such a double bind? No. The only one that comes to mind as being harshly criticized was Bork, and with good reason.

Sorry for being so long-winded, but this really gets to me. I think it is clear that Sotomayor is NOT an activist. She has primarily agreed with employers, for example, with respect to employment discrimination claims. I think she will follow the law and I hope she will apply the law in a way that promotes fairness and is true to the spirit of the Constitution. There are no guarantees, of course, but there appears no reason to deny her confirmation.

Shadow – add my name for 10 pages…I’m not a legal guru by any means but – there ARE differences in key words to watch for: example: ’shall(or will) & should’ vs. ‘can & could’. I think we also need to be aware of intentional obtuseness by our congressmen/women. :(

Will add you name to the list when we get a few more people. I know the wording is similar to reading court papers and open to interpretation on purpose, but we can just relay the info from a common woman’s viewpoint which is better than anyone in congress that isn’t bothering to even read it.
This will also need to be approved by Muphy to have us do this, since like last time we did this, it was put on a separate page of the blog.

I think that is the only thing that he has been successful so far, well, not 100%. People have already started to see the truth, and his popularity is going wayyyyyyy down. I’m not an attorney (as you likely may be), and probably don’t understand some of the finer points, but my ultimate question would be, why DIDN’T Sotomayor question the test? My hunch is that had Ricci been a person of color or female (instead of being a learning-impaired white male), Sotomayor very likely would have questioned the test as a promotional tool. So, IMO, her activism appears to be evident; but appears to be quite selective, hence the question of whether she can apply the law equitably/impartially concerning all persons across the board.

182 CJK – it is really hard to grapple with the questions raised in a brief comment, so I am sorry for causing any confusion with my general comments. I will try to answer your very good question. Ricci scored well on a test that had a disparate impact on persons of color. The test could not legally be used to promote anyone because allowing the test to be a promotional tool would have resulted in blacks and hispanics saying that the promotion was tainted. The city did the right thing by not using the test. No one was promoted either because of the test or because the test was not used. In this way, the city was trying to avoid a lawsuit altogether.

Ricci said that the city’s refusal to use the test was a race-based decision. In a way, yes, it was, but every employer has the obligation to refrain from using testing tools that have discriminatory results.

A very well respected judge on the Second Circuit wrote a concurring opinion in support of not reviewing the decision, so Sotomayor is in good company. Part of the basis for the 2nd circuit not reviewing it concerned the request for Supreme Court review – the issues were already well defined, so there was no need for the Second Circuit to get into it with an opinion. One of the judges who disagreed, who is quoted in the article you linked, said that was a mistake because the panel Sotomayor was a part of approved without analysis the trial judge’s opinion, which according to some did not accurately address Constitutional law.

So, definitely there are reasonable and bright judges splitting up on different sides of this issue. The Supremes’ decision changed the law, and that was something the Supremes could do, not something a three judge panel in the Second Circuit should be doing. That’s why I think what Sotomayor did shows she is not an activist judge.

Persephone agrees with you, I think. I haven’t seen her weigh in on this in a while, though. I may be completely wrong about her – I have not studied it as much as it could be studied.

It is pretty rare for someone not to be confirmed. Certainly, I question anyone Obama selects, but I am trying not to hold that against Sotomayor. ;-)

Airforce, maybe I don’t understand, but I’m reading that bo supporters thought that the Executive Order he signed was great because it revoked Bush’s order (Executive Order 13233) limiting access to presidential records. But the way I read it, it simply replaces it and is still unconstitutional as it basically say the president can claim executive priviledge on whatever he chooses. This would violate the Presidential Records Act 44 USC 2201-2207 stating that records of the president belong to the public and are not the property of the president.

A couple tried to tell me that I needed to contact my own rep. however, I told both “Women need to support women, and since there are so few in Congress, I feel she IS my representative!” SILENCE, then they took down information.

Timing is really bad right now, and they are all going on break for a month!
3 isn’t a lot, BUT it’s three more women with their eyes open a bit, perhaps.

Well back from my walk. I ran into another woman walking her dog. She saw my Puma shirt and we started talking. Of course she voted for bambi, but as we were talking she agreed that indeed he has not “followed through” on his campaign promises. Ya think?! Turns out…lo and behold..she is one of our councilwomen.I knew I recognized her. She is the daughter of a prior mayor of Gary. She is going to run for Mayor against Rudy Clay in 2010. I told her even though I do not agree with her as far as Bambi is concerned, I would support her because I am a woman,and after what happened to Hillary during the last election, and to Sara Palin I am supporting only women as long as they are qualified. I believe that only a woman can get this City on the right track with the budget, and bringing in jobs and diversity. I told her I will however watch her voting record, but what I know of her voting record in the City Council so far I pretty much agree with. I know her father did more for this City than any other Mayor. She said she would check out our blog, and will contact me so we can sit down and talk further.
Not bad for a pissed off Puma’s nights work.

Oh Anti, I have a son too and know just how that goes. Those damn hormones. My son had to move home for the summer, couldn’t find a job and has little jobs now and then, what ever he can find before going back to school. Keep those boys working and off the streets. :lol:

I’ll manage though. It’s not that I don’t have the carpentry skills, it’s that I’m old and decrepit. If I put in a full day of labor in this oppressive Georgia summer sun, I can barely function the next day and need two days to recuperate. :) Oh well, it will be finished when it’s finished. There’s no rush.

Oh (((BillieJo))), Tell me about it, I’m about sick of my son’s hormones. Even when we were on vacation, 350 miles from home, he stayed out all night with the car, leaving me to worry my ass off in a hotel room. The next day, he was incredulous because I was upset about it! Go figure!

I had to check out last night as it was very late and I was tired. It was just a flying visit to share the videos with you. (or so I hoped) it was just on the BBC last night.

Sorry that the videos don’t work in the USA I did worry about in case that happened. I expect they will be on youtube soon if someone posts them. I doubt the BBC will be too happy though! lol.

This is NOT the actual video from the Dragon’s Den show, as I don’t think that it is on youtube yet, but it is an interview with the inventor Sharon Wright. I think she’s great! I love to see great women inventors and there are many, but this one just had a “eureka” moment as she describes it, and her pitch on the Dragon’s Den was amazing!
