I wanted to let you know that we now have a full-time voting-rights attorney at Advocacy, Dustin Rynders, so I am copying him on this email.

The kind of civil rights violation referenced in the article occurs, and much of it is directed against persons with intellectual or psychiatric disabilities. This is certainly something Dustin is aware of, and he will want to know if you hear of any such thing taking place anywhere in Texas . As far as publicity, I know Dustin has been spending a lot of his time sending out voting-rights information across the state, and he has also been making presentations to disability groups and persons residing in (or being served at) institutions around Texas (as have other Advocacy staff).

I also wanted to let you know that I turned over to him all of the information I received last spring about voting problems in the Democratic primary in the greater-Dallas area. I know he is in touch with the political parties, and he has indicated to me that the state Democratic Party is reconsidering whether to continue the in-person caucus system at all (where all the problems I heard about occurred).

Please feel free to send any voting issues that come to your attention to drynders@advocacyinc.org. No doubt he will not be able to get to everything, but his energy and dedication will mean that your information will be welcomed, and will definitely be considered.

They say the adult day rehab program where Jack Justice attends took him to vote, without the family’s permission. What’s worse is Justice says the person helping him wouldn’t cast the ballot for his choice for President.

Jack Justice has been voting since he turned 18. Typically his family takes him to their neighborhood precinct. This time Primus Industries, his adult day rehab program, took him to vote. His family was shocked, but what shocked them more was that Jack claims that his aide commandeered his vote.

“They told me to vote for Obama, I said no I wanted to vote for McCain,” said Jack Justice, a voter.

Jack Justice says the person helping him, selected Obama’s name. His sister says the family is often asked to sign a permission slips for trips, but for this they were never notified.

“No permission slips, no nothing, he just came home and said he had gone,” said Nancy Justice, Jack’s sister.

When every Web site was saying that this African Press International piece was the real deal, when everybody was ready to broadcast Michelle Obama’s purported statements from the tops of the tallest buildings in town, I knew something didn’t smell right, and I gave my reasons why.

One, Mrs. Obama is on the tightest of leashes, unable probably to even speak with the likes of Katie Couric and Diane Sawyer and three-quarters of the cast of The View. Two, Mrs. Obama may have an anger problem, but she is far too intelligent to say such inflammatory things so close to her chance to finally be really, really proud of her country. And three, even if Michelle Obama wanted to speak out against some grave injustice, she would not have chosen African Press International to do so.

That was my line of thinking. That still is my line of thinking. However, suckered in by the seductive chance that there were somehow audiotapes out there, I chose to go against my gut feeling and participate in the Internet forum to-and-fro that I’ve steadfastly tried to elevate America’s Right above since its inception at the beginning of this year. I’ve tried to be above rumor, and in this instance haven’t lived up to those aspirations.

It smelled funky from the get-go, and I need to remember to trust my gut … which, as I always say, is ample.

Philip Berg, in our conversation this evening, was similarly dissapointed by the apparent backtracking by the folks at African Press International.

“Everything depends upon what they actually have,” Berg said, mentioning what was reported earlier as an apparent attorney-client relationship in the works between him and API. “I need to speak with them again.

I asked him why he would agree to talk about representation without seeing, firsthand, the evidence in question. Berg said that the representation talks were essentially in preliminary stages, and nothing was set in stone.

“They supposedly have documentation confirming the telephone records,” he said. “I will only represent them if they provide me with the documentation that they said they have, including the telephone records. Otherwise, if they provide me with nothing of what they promised, I will not be associated with them.”

For me, a lesson learned. As this little story descended from potential news into simple humor, I should have known to jump ship. Next time, I’ll wear flippers.

I have a question/rant: why is that when I look at an electoral map, I see America is mostly in American Red, with a few dumbass blue states but when all votes are added the small blue states add up to more than the red states?

Who decides for instance that New Hampshire should have the same number of votes as Alaska, which is full of God given natural resources?

Not sure about the law, but the literature says that they have to be at least briefly “consciously visible” to work. The ‘flip rate’ of the human eye is about 1/25 second, so that’s probably how long they’re up.

I explained respectfully to the lady that answered that I supported Senator Clinton in the past because I believed in her. So with that in mind, I can no longer support her actions in that manner and I requested a refund of my past contributions.

The lady was very nice and said she understood and took my name and information and said I would receive an email regarding the refund in a few days. It felt good to take that action.

(CBS) It’s crunch time for volunteers looking to register new voters. In Florida, Democrats and Republicans alike have registered more than 130,000 new voters in the last month alone, leaving election workers scrambling to get them all on the rolls by Election Day.

But as CBS News correspondent Kelly Cobiella reports, the state’s stringent fraud prevention laws may keep some of those newly registered voters – and many others – from casting their ballots.

“This is just outrageous how many people are really into this election,” says volunteer Aleisha Hodo.

The sheer volume of new voter registration applications, along with the state’s so-called “no match, no vote law” has election observers worried that one mistyped number could disqualify a ballot.

“We have done the math and we have begun to look at how many people are not matched, not voting already, and it could be in the tens-of-thousands in the state of Florida,” said Dierdre McNabb of The League of Women Voters.

For the first time, Florida law requires a voter’s driver’s license or social security number to match a state or federal database. It’s done to prevent fraud. Several other swing states have similar laws, but none as strict as Florida’s. Wisconsin dropped its own no match rule when a test run showed one in four voters would have been eliminated because of typos and other minor problems.

“Already we’ve seen that over 5,000 people, as of this last Monday, have had their voter registration applications rejected,” says Tova Wang of Common Cause. “The county administrators admit that it’s because of mistakes like typos and variations on people’s names.”

Take for example Tameka Collins. When she applied for an absentee ballot, the elections office sent her a letter saying her signature didn’t match. She had to re-register last month, after being a regular voter for years.

“Now I feel like I have to go and vote in person, just to make sure it counts” Collins said.

Local election officials say they’re trying to clear up the problems before Nov. 4.

“Our objective is to reach the voter as quickly as possible to resolve the issue,” says Deborah Clark.

Basically it looks like Obama has lost his case against Berg. He failed to answer questions within 30 days. This is on the American Right web site by Jeff who speaks for Berg in some cases.

I think there is good chance that Obamas lawyer purposely did not file. They have no way to answer the questions and thus will claim loss by accident. Obama may use this to cause riots. I doubt this happened by accident.

According to Rule 36 of the Federal Rules of Civil Procedure, a party upon whom requests for admissions have been served must respond, within 30 days, or else the matters in the requests will be automatically deemed conclusively admitted for purposes of the pending action.

On September 15, Philip Berg served Barack Obama and the Democratic National Committee with a request for admissions. Barack Obama and the DNC acknowledged service in their motion for protective order, filed on October 6 in an attempt to persuade the court to stay discovery. The Federal Rules require that a response be filed within the 30-day time limit, and Barack Obama and the DNC have not. Therefore, this morning, Philip Berg will file two motions:

A motion requesting an immediate order deeming his request for admissions served upon Barack Obama and the DNC on September 15 admitted, and
A motion requesting an expedited ruling and/or hearing on Berg’s motion deeming the request for admissions served upon Obama and the DNC admitted.

Berg contends that the failure to respond and serve the response within the time limit is “damning,” and made two appearances overnight on Rollye James’ talk radio program, the second one coming shortly after midnight, during which he disclosed the meat of today’s filings and the ramifications the defendants’ failure to respond may have.

“They did not file answers or objections or anything else to the request for admissions we served upon them on September 15,” Berg said to me shortly before midnight, noting that Obama and the DNC did in fact acknowledge service of the admission in their motion for protective order. “They knew the admissions were due. They knew they must object or answer specifically in 30 days. Here, they did nothing.”

Typically, requests can be used to ascertain three types of information: (1) the veracity of facts, (2) the authenticity of documents, or (3) the “application of law to fact.” Pretty much anything not privileged is fair game, and while the idea behind such a request is to obtain information, requests for admissions of facts and of the genuine nature of documents are generally not designed as a part of discovery, per se, but rather more of a mechanism used to whittle down proof later in the proceedings.

Unless permitted by the court or allowed pursuant to a written agreement between the parties, the party served with the request must serve a response within 30 days. How serious is a failure to respond? This, from PreTrial, by Thomas A. Mauet:

The automatic provision of Rule 36 makes it a formidable weapon because inertia or inattentiveness can have an automatic, and usually devastating, consequence. Hence, there is one cardinal rule for practice under this provision: Make sure you respond and serve the response within the 30-day period.

Just what were some of the admissions that Berg asserts Barack Obama and the DNC have, at least procedurally, admitted to?

**Admit you were born in Kenya.
**Admit you are a Kenya “natural born” citizen.
**Admit your foreign birth was registered in the State of Hawaii.
**Admit your father, Barrack Hussein Obama, Sr., admitted Paternity of you.
**Admit your mother gave birth to you in Mombosa, Kenya.
**Admit your mother’s maiden name is Stanley Ann Dunham a/k/a Ann Dunham.
**Admit the COLB [Certification of Live Birth] posted on the website “Fightthesmears.com” is a forgery.
**Admit you were adopted by a Foreign Citizen.
**Admit you were adopted by Lolo Soetoro, M.A. a citizen of Indonesia.
**Admit you were not born in Hawaii.
**Admit you are a citizen of Indonesia.
**Admit you never took the “Oath of Allegiance” to regain your U.S. Citizenship status.
**Admit you are not a “natural born” United States citizen.
**Admit your senior campaign staff is aware you are not a “natural born” United States Citizen.
**Admit the United States Constitution does not allow for a Person to hold the office of President of the United States unless that person is a “natural born” United States citizen.
**Admit you are ineligible pursuant to the United States Constitution to serve as President and/or Vice President of the United States.

Well it seems to me that is the entire case.

Can all this be destroyed by claiming that Berg did not have status to bring the lawsuit in the first place. That was my original guess that Obama would not respond to anything and would appeal to the US Supreme Court. I believe it is all true so there is nothing else for Obama to do.

Hopefully the MSM will finally cover this story. Obama has legally admitted to all those facts. That is a story.

I think we should all, as a respectable PAC trying to beat O politically, offer a prayer or show of desire for his grandmother’s speedy recovery.

A young employee that I successfully enlightened about Obama today asked what happens if Obama wins.. Good question. I don’t know – we can’t think about it. A large part of me can’t wait till Nov 4 so we have our life back.

For now, we will keep doing everything we can to make sure Obama doesn’t win.

I wanted to post reasons I’m not voting for BO on the previous threads, but everybody said everything I was thinking already, and so much more eloquently than I could design.

To simplify–when interest in this candidate became adoration, fawning and obsession, I knew something was wrong. When Oprah proclaimed him as “The One,” I knew the world had tilted off of its axis. When young folks who haven’t lived two decades began chanting over him like lovesick rockstar fans, I became sick to my stomach.
There is no true substance there, and just running for president for almost 20 months does not qualify you for the presidency. Is this a case of “If you believe a situation is real, it has real consequences.” ??? Is this a case of a gifted, hypnotic man saying it enough to persuade the gullible? And the not-so-gullible? And the media?? Something is very, very wrong here.

My family (all Democrats, except for one Republican sheep) are disgusted and voting McCain-Palin to counter the craziness.

And should (gulp, sob) he actually win, I know I will personally be devastated that America fell for him and destroyed the Democratic Party. The Dems who masterminded this sham will have won, and there will be no reason for them to reform, because their tactics got them what they wanted. I, personally, am going to have a tantrum that may be registered on the Richter scale.

I have been issuing reports from Hawaii and we are on the streets digging for the truth. This weekend we issued our story list for Monday-Wednesday (Monday has been rescheduled—see above).

What has Obama done? Cancelled his campaign and announced he is jumping on a plane to join Andy Martin in Hawai’i. Welcome home, Barry (Obama’s grandmother calls him “Barry.”)

Was I right when I predicted Obama made a classic mistake when he attacked me? Will Jim Rutenberg and all of the other Times slimeballs regret their malicious attacks? You betcha.

Obama did not pay any attention to his grandmother until I showed up in Honolulu. Suddenly she is the center of his attention. She is so central to his campaign that he has suspended it! But when Obama was here last summer he only visited his grandmother for an hour. One hour! Now he suspends his campaign for her?

Could anyone have predicted a more dramatic series of developing events? Hannity puts me on the air as the Chicago expert who confirms the links between Obama and his longstanding anti-American, terror network. Obama’s goon squads immediately try to smear me in retaliation. The New York Times creates a front-page story out of 25 and 35 year-old nonsense in a desperate attempt to discredit and derail my upcoming Hawai’i investigation.

And Andy Martin’s investigative team lands in Honolulu and goes where no mainstream media have gone before, on the streets of Honolulu to dig out the secret truths about Barack Obama.

Hawai’i Five-O looks tame by comparison.

I am still standing, fighting, and investigating, right here in Obamaland. And Hannity’s dramatic show on October 5th will prove to be the turning point in the fight to retake America from the Obamabots and their crooked clandestine campaign cash (Without Andy, Hannity’s second show on October 19th was dull by comparison and provoked no response from the Times or Obama).

The day we landed in Honolulu was Obama’s D-Day. He can’t scare us. He can’t stop us. He can’t intimidate us and the New York Times can’t smear us with lies, half-truths and distortions.

The irony in all of this television drama is that Fox News is not the network following me around Hawaii. I will leave it to the network to disclose which one it is.

Barack Obama is looking increasingly like a desperate, doomed candidate whose Big Lie is about to be exposed.

The New York Times tried to suggest I exaggerate. Do I exaggerate? Apparently Barack Obama doesn’t think so. He knows what I know. And soon you will know what Obama and I know.

What Obama fears most is that I search for the truth not because I am associated with McCain (I am not) or because I am a partisan Republican (I am not a right-winger). Rather I search for the truth for the sake of the truth, the whole truth and nothing but the truth. I took an oath as an 18 year old to defend the Constitution of the United States from its enemies.

Barack Obama is an enemy of the Constitution. He is using tens of millions of dollars in clandestine campaign cash from unknown sources to stage an electoral coup d’etat in our nation. That is why I keep fighting for the truth.

Barack Obama has been lying to the American people. And his Big Lie is about to be exposed.

Now that his secrets are on the verge of being revealed he has panicked and suspended his campaign to visit Hawai’i. Do you believe Obama’s explanation for the sudden trip?
